The decision to schedule the sentencing days before the inauguration almost certainly means Donald Trump will be the first felon to serve as a U.S. president.

If Biden follows Trump's example and doesn't attend his successor's inauguration, it would be a nice gesture if Biden showed up for Trump's sentencing.

    He already has been a 34-count convicted felon for some time now. He'll already definitely be the first convicted felon president in our nation's history.

    HtS among others have been holding out hope that Trump could win on appeal, which could result in a retrial in which Trump might be found not guilty.

    Whoa, Curt.

    As pb said previously, after the sentence, Trump will, finally, be able to appeal.

    Let pb predict what will happen.

    Trump will appeal to the NY Supreme Court and the conviction will be upheld. Then he'll appeal to the US Supreme Court and at least one of the Justices will die laughing at the absurdity of the trial and the Court will toss the conviction half way across the Atlantic.

    tRump owns 6 of the Supreme Clowns so they would definitely let him off if it gets that far. But it would still be hilarious if Biden showed up at the sentencing phase. He could pretend he's there to support "the office of the President" and recommend a long sentence.

    Contrary to HtS’s prediction above, I predict Trump will NOT have his conviction dismissed or overturned by the Supreme Court. Trump may pardon himself and declare himself “innocent” and HtS will believe him. But for the rest of us and historians Trump will be the felon president.

    Indy, you think I am naive, do you? Be sure to point out if and when my prediction is wrong. HtS claims "the [Supreme] Court will toss the conviction half way across the Atlantic". I don't think so. I haven't found any examples of the US Supreme Court ever overturning a criminal conviction in its more than 200 year history.

    The Supreme Court has ruled in favor of an indigent defendant appealing his conviction and sentence, but that was based on an inadequate, incompetent defense. It still required a retrial.

    I assume you know that appeals are not retrials. A successful appeal needs to demonstrate some flaw in the trial: a bribed judge or jury, some technical judicial error, wrong law applied, etc. If the Supreme Court agrees to hear the appeal, Trump's lawyers won't be presenting exculpatory evidence. If Trump "wins" in SCOTUS, he gets a retrial in a NYC courtroom.

Trump will never go to jail.* We’re down to one conviction according to threads on the board here. Trust me when I say if the Supreme Whored don’t save him - the Democrats will. 😉

    I always thought the lawfare to have been an obvious political ploy. My Legal Goobers, none of whom are MAGAs, two of the three are actually Dems, thought the only remotely legitimate case was the Documents case.

    Politically? The people whom I regard to be fair-minded, to the person, believed that persuadable voters would see the politically charged antics... which, obviously they did.

    Every time a Dem gloated that Trump is a 34 time convicted felon, independents were seeing a Trump ad compelling people of reason to seize the reigns of political power away from our corrupt DOJ and, as much as possible, away from progressive DAs in lib cities. Did you notice that Trump took Georgia fairly easily? And, his vote total in Manhattan far exceeded expectations?

    Jonathan Turley expects the sentencing to be a nuthin burger since Trump is being permitted to attend virtually. That seems about right.

    Ole pb thinks that Dems should just surrender the lawfare. pb's stunned that Trump got Mike Johnson in as Speaker on the first ballot. Heck, even the unruly House GOPs are falling in line.

    And, if the Dems want to give the GOPs any chance at holding Congress in 026, let them try convicting Trump of something. Baha.

    Here's what I'm hearing from my Legal Goobers:

    If Merchan gives Trump a meaningless sentence, which may be likely since he's not even requiring Trump to physically appear at the sentencing, the case may, essentially, come to an end for all practical purposes.

    If he imposes a sentence of any consequence, Trump’s appeal to the New York Supreme Court, which is political, will probably uphold the conviction. If so, Trump will appeal to the US Supreme Court which will have a virtually limitless number of grounds to overturn.

    I've been clear. I'm no lawyer but my Legal Goobers are unanimous and certain that, if the case gets to the Supreme Court, it's certain to be overturned.

    There is a big "if" in your pundits' unanimous prediction. Merchan is hinting it will be slap on the wrist type sentence. That's why I doubt that Trump would even risk appealing his conviction. If Trump did, there are a few possibilities:
    1. Maybe there would be reversal of the conviction, which in that case he is deemed not guilty. That is a remote possibility, imho.
    2. Maybe the court won't hear the appeal.
    3. Maybe the appeal is successful and it goes back to the NY court in which case, he would tried again facing the possibility of a harsh sentence. That would happen after he leaves office, btw.

    I was not commenting on your prediction in any way. The only thing I'm saying is what I've been saying from day 1 - Trump will serve no jail time (and probably no other punishment either).

    I am glad we all agree. Trump will forever known as the felon president. SCOTUS will not "de-guilt" or "un-felonize" him.

    Other than Indy's IndyPennedIt illustration of Trump behind bars and other wishful thinking, there has never been serious scenario in which Trump serves jail time. House arrest maybe.

    Maslow's hierarchy of needs comes to mind. At Trump's level, the highest level and at his age, being branded a felon is hardly what he wants said about him in the history books and his obituary.
