Why are TV lawyers bamboozling Trump supporting rubes into thinking there’s a legitimate case of double jeopardy?

The charges against Donald Trump in his second impeachment:
Incitement of insurrection

The Jack Smith-led charges against Donald Trump in federal court:
Conspiracy to defraud the United States
Conspiracy to obstruct an official proceeding
Obstruction of and attempt to obstruct an official proceeding
Conspiracy against rights

A person does not have to be a Supreme Court legal clerk or a law professor to know that recidivist can face different and multiple charges many times over the course of his criminal career.

For those who did not go to law school but not wanting to be hoodwinked by Fox News legal pundits, it helps to have paid attention in your high school American government class or to have made an effort to read the United States Constitution.

The Double Jeopardy Clause in the Fifth Amendment to the US Constitution prohibits anyone from being prosecuted twice for the SAME crime.

Sorry, Curt. Remind me again. Which Supreme Court Justice did you clerk for?

Just wondering. Because apparently you watch Fox a whole heck of a lot more than ol pb, who's saying that Trump'll get off on the Double Jeopardy scam?

  2. by Curt_Anderson on December 27, 2023 10:25 am
No, I don’t watch Fox News, but I have read your posts citing the legal pundits who appear on FOX News, NewsMax, etc. and their arguments of double jeopardy in Trump’s trials.

And, that is what you read?

Yes, I read it most recently in your comment #29 in the link below.

Here's what pb's hearing from the Legal Goobers:

Trump probably won't prevail on immunity...

That's non sequitur. This thread is not about immunity. You also posted, citing your preferred legal pundits, "to charge him criminally, amounts to a type of double jeopardy."

For the record, it not any type of double jeopardy.

Curt - have you ever watched Fox... ahem... "news"? I have - not because I want to, but because my dad is ill and when I see him, he keeps trying to get me interested in Faux. It's below idiot level. To say they are aiming for the lowest common denominator when it comes to viewers would be an insult to the lowest common denominator. They must be paying some of their "talent" a ton of money in order to get them to show up everyday because they can't all be that stupid or willing to lie all day about everything.

    Indy,
No, I don't ever watch FOX News Channel. The closest I come is watching a video clip somewhere like on a late night comedy show or here of a ridiculous FOX News segment.

I am convinced that Alan Dershowitz aside from whatever he is paid to make disingenuous legal arguments on TV, enjoys playing the devil's advocate---which he has history of doing.

One thing I find very interesting is how well their propaganda works on people. Because when my father and I discuss the issues - he is generally a supporter of liberal ideas. For instance, his views on health care generally lean towards the idea of universal healthcare - but if you actually say those two words together - he claims it's "socialism which leads to communism" because he's been programmed to say it from all his Fox exposure. When you actually watch a half hour of some Fox show - The Five, Hannity, whatever... it's amazing how text book the propaganda is and how prevalent. It's in everything they say and do. The dirty word for every day is "liberal" - any and every problem of the country leads directly back to "liberals" and the "democratic party" which they believe are one and the same. Harold Ford is on one of their shows and my Dad is convinced he's a flaming lefty. 😂

Precisely. That's significantly why I'm boycotting Fox. But, in truth, your comment is true of all of cable "news." Ain't?
