(Reuters) - A federal judge has dismissed charges against a Kansas man for possessing a machine gun, saying prosecutors failed to establish that a federal ban on owning such weapons is constitutional.
The decision by U.S. District Judge John Broomes in Wichita on Wednesday appeared to mark the first time a court has held that banning machine guns is unconstitutional after the conservative-majority U.S. Supreme Court in 2022 issued a landmark ruling that expanded gun rights.

The SNL thing was after some town passed a law that everyone had to own a gun. So the gag was the town passed a law everyone had to carry a nuke. So everyone has a nuke under their arm and they're trying not to get into arguments so nobody drops their bomb.

I've had my eyes on one of these puppies for some time now. The guy wants seventeen thousand bucks for it though. I think he might take fifteen. Says he got it through a misdirected arms shipment.
I just hope I can raise that kind of money before some deranged lunatic with deep pockets beats me to it.

Oh the seller was quite keen to show me how it works. I said I didn't need any lessons yet though until we closed the deal.

Although this is a "fully automatic gun, my guess is that it's between a 9mm and a .45 cal. Yes, they are legal. Their firepower isn't like a rifle. It's a pistol that's really hard to handle even at "short-range" (within 50 meters).
Myself? I think they're a waste of money. If I have a fully auto weapon and needed to get out to 700 meters, I'd much prefer an M60 with .308 rounds, or my AK/M4 without the full auto feature. Much better to handle. The M60 BTW is 27 lbs alone then there's ammo which is heavier than most hand carried guns.
I'm pretty apathetic about this. At 50 meters, you might be able to stay on a barn side, but no guarantees. As far as point and shoot? after the first round, you're really off target. Maybe if you're in a room and want to waste ammo. I guess...

Prosecutors do not have to show that anything is Constitutional. They prosecute according to the law and it would be for the defence to argue that the law is not Constitutional.
That would then likely be referred to a Court where a judge who did know law would preside.

If found guilty, the defense would start the appellate process. The rest of what you said is perfectly true.
I Agree with you and support you, IF there is a constitutional issue, then it goes up the chain of courts who argue the law is constitutional or not. This is a "newer" law and I'm not sure if it's made it to the appellate courts yet. Again, I'm not impressed with the equipment to care too much about it.
