Supreme Court rules that California cannot hide children’s gender transitions from parents; landmark decision protects parental rights nationwide

The landmark 6-3 decision is the most significant parental rights ruling in a generation. The Court found that California’s secret transition regime likely violates parents’ rights under both the Free Exercise Clause of the First Amendment and the Due Process Clause of the Fourteenth Amendment, holding that the state “cut out the primary protectors of children’s best interests: their parents.”

“This is a watershed moment for parental rights in America,” said Paul M. Jonna, Special Counsel at Thomas More Society and Partner at LiMandri and Jonna LLP. “The Supreme Court has told California and every state in the nation in no uncertain terms: you cannot secretly transition a child behind a parent’s back. The Court’s landmark reaffirmation of substantive due process, its vindication of religious liberty, and its approval of class-wide relief together set a historic precedent that will dismantle secret gender transition policies across the country.”

On the First Amendment, the Court declared that California’s “unconsented facilitation of a child’s gender transition” is an even greater intrusion on parents’ rights than the government actions struck down in last year’s Mahmoud v. Taylor. The Court’s forceful reaffirmation of substantive due process sets a landmark precedent for parental rights nationwide, holding that parents, not the state, hold primary authority over “the upbringing and education of children,” including the right not to be “shut out of participation in decisions regarding their children’s mental health.”

The Court also rejected the Ninth Circuit’s attempt to dismantle the class certification, finding that the parents protected by the injunction “very likely have standing” and that “class certification was likely proper.” This precedent-setting holding ensures that the injunction protects not just the named plaintiffs but entire classes of California parents—effectively shielding teachers as well, since the class-wide parental victory prohibits the very policies that teachers were being compelled to enforce.

    It's a good thing this is done. Finally, as usual, somebody had the stones to take it up and not waste time and money. This is a ditto of what courts have been saying for what, three to five years? I'm just a little shocked that it took this long and the horrible number of cases to come back to the prior SCOTUS decision that it was unconstitutional. Period. EOFS. The schools' standing on this was just stoopid. We DO have failsafe in place for children. Because someone believes "differently" is not a reason to take their children. I know it's the liberals' wish to make every child a "ward of the state" so they can get the same education they do in China. That isn't here though.

    It was well written also. Plain talk. Just the "no you can't."

    LOL! at the notion that a minor would be able to "transition" without their own parents knowing. What some are calling "transitioning" isn't really transitioning. Physicians have always needed permission from the patient's parents or guardians before performing a medical procedure or prescribing prescription medications for a minor.

    There are also larger issues are about the books being used in the curriculum and the "acceptance" of those gaming the system (generally males) "saying" they are transitioning to get into female showers and rest rooms.

    The books that can't be read in public. Oregon is one place where these books have been in the curriculum for as young as kindergarten. These books incorporated LGBTQ themes in grades as early as kindergarten including the promotion of Queer Theory concepts, as well as sexually inappropriate and even explicit language in other grades including excessive profanity and frequent descriptions of underage drinking, fondling, masturbation, orgasms, oral sex, sexual intercourse, sexual abuse, statutory rape, incest, and rape.[1][2]

    The other issue is males gaming the system by "saying" they are transitioning in order to gain entry into female restrooms and shower facilities. As I've always said, is I don't believe for a second these guys will ever transition, and they're not even groomers. They are serial rapists. I believe they should be dealt with as such. What does have me vexed is the lack of the trans community not stepping up on this issue. It seems to me this is the biggest black eye they can get. And with some folks, they'll keep the narrative that the rapist is a trans.[3]

    The other thing we're also seeing is this same game is played by convicts to get into women's prisons.[4]

    Sexual assaults in bathrooms do occur, of course, but the research shows that it is rare and not connected to transgender-inclusive policies. Locations that have adopted trans-inclusive policies show no related uptick in criminal behavior. In fact, the danger comes from the opposite direction: transgender people themselves are subject to elevated risk of harassment and violence in bathrooms.


    I swear, MAGA just isn't happy unless they have their boogeymen.

    The thing that distresses me is that the science of so-called "trans" has become politicized... by both sides. Still, it seems to pb that "trans" people consist of individuals suffering from one of two mental illnesses:

    1. Gender Dysphoria, from which po and Donna suffer, and,
    2. Autogynephilia.

    An autogynephiliac is a male who achieves arousal by the thought or image of himself as a woman. These are the people who rape or sexually assault in women's public restrooms.

    IMO, rape and sexual assault, while important, are a side issue. The overwhelming majority of honest to goodness biological females want public restrooms and locker-rooms to be safe spaces, where people toting around a Y chromosome are prohibited entrance.     Because I can absolutely assure you with 100% certainty that that is not the way it ever works.

    I was out of high school before I found a total of three books in a university library on the subject of transsexualism. Not having the data I needed before that didn't keep me from being a transgender person. I knew what I was since about the age of seven. For many, they know way before that.

    Why is it so important for ignorant, bigoted people to keep trans children from knowing who and what they are? Why is their suffering in the darkness of mental torment through their whole childhoods so important to you people?

The point here is NOT about trans folks, it's about straights (usually males) posing as trans to be allowed in the restrooms, and showers in the school. Like I said, they're gaming the system. This has nothing to do with those that actually have gender dysphoria. That's a whole different story. The other piece of this is they covered up the assault and didn't inform the parents about it. They transferred the male, where he assaulted two more women. And they district kept those quiet also.[1]

    I see. This is all NOT about us trans folks.

    The fact that laws are being made to keep trans folks from using their appropriate rest room facilities has nothing to do with trans folks. It's not about trans folks when it is being made illegal for trans folks to use their appropriate rest room facilities. Trans folks using their appropriate rest room facilities being made illegal is not about them, it's about dealing with and eradicating a crime that doesn't exist. It's not about trans folks at all.

    It's all about keeping non-trans men who game the system from committing crimes that they don't commit. Nothing to do with trans folks at all. Perish the thought!

    Yeah, I suppose I see the logic of all that. Oh well. We gotta think of the children.



    On a slightly different topic...

    You know, there's a really easy way to stop all these horribly tragic school shootings. These are crimes that are real and actually do occur. Way too often in fact. So, obviously we need to somehow keep these criminals from gaming the whole Second Amendment system by just keeping guns out of their hands.

    And that can easily be done by just taking away all guns from civilian gun owners so that no one has any guns.

    Oh, now I know this will upset the Second Amendment folks to all get-out. But this isn't about them or the Second Amendment at all. It's about murderers gaming the system to get away with shooting up schoolrooms. It's not about the right to bear arms or any of that. Perish the thought!

    So, I'm sure that the Second Amendment folks will eventually come around and just accept that this is a small, reasonable price to pay to stop school shootings. A crime that actually exists and has rsulted in thousands of American children's deaths. It's not just some bullshit excuse made up by some radical, anti-Constitution group to take everyone's guns away. Gun owners can just switch to collecting knives. I mean... for the love of God, think about the children!

    No one actually needs a gun. A perfectly happy life can be lived without even touching a gun. It's not like having a gun is the same as... oh, performing a bodily function that everyone has to do several times daily or anything like that. People can easily live without guns. I do it. I know lots of people who do it. No one needs a gun. So do away with them and no school kids get slaughtered! Easy peasy!

    The Second Amendment folks would just need to stop thinking it was all about them.
