The ban “brands all transgender people, without regard to individual merit, as unworthy to serve in our armed forces solely because they are transgender,” Judge Cornelia Pillard wrote.

In practical terms, nothing gets easier for transgender troops. The military can continue enforcing the ban because of the administrative stay and a separate U.S. Supreme Court order in a related case, United States v. Shilling. Now, the appeals court has explicitly said the ban should remain in place...

Today, the court declined to halt the unjust discharge process now threatening thousands of transgender service members," National Center for LGBTQ+ Rights legal director Shannon Minter, who represents transgender military members in the case, told The Advocate after the ruling."

    I read the dissent. OMFG. are we sure this woman actually graduated? It sounds like concha ranting about a "legal" issue, or a an easily political position. Someone that doesn't understand the basics of the constitution. She can't identify "states rights" vs "federal over watch."

    If a state makes a ruling, it cannot, according to the constitution, over-ride the constitution or Federal Law. Same thing goes with "district" courts. Although they are in the "federal" court system, they can only rule for their district.

    That's in PSCI 107. It's a basic course you take as an elective for "art School" majors, because the balance of a Bachelor's degree is to have a well-rounded education. A "master's degree" is your specific area. Although I think that has changed in modern education.

    Judge Cornelia Pillard earned her Law degree at Georgetown and teaches constitutional law there. I have a feeling that she knows the law better than you.

    Guaranteed lots of transgenders continue to serve. Just like gay folks did when they were banned. Just ask Odorous - he slipped totally under their gaydar his entire career.

    +They do only rule on cases in their jurisdiction, OD, but the Law is the same everywhere. Precedent established in Nome, Alaska, applies in Baton Rouge or whwereever.

    Not necessarily. SCOTUS has already ruled on this. Twice. The circuit court can ONLY rule within their district. And, that ruling is applicable to that district. It's another part of our federalist system.

    The difference with Trans is that information is in their medical records. So that's easy to find.

    The biggest issue for me was often, the folks gamed the system to get the military to pay in both money and time.

    Then of course, you had the "housing" issue that came to a head in 2023 when a female soldier was forced to house with males in transition. They were undergoing the hormone treatments, but had not had the surgeries. At that level in the military, this is an open bay (everyone's in the same room), and one common shower area according to pedojoe's ruling.

    I don't care if they go in to the military after the surgeries, etc. Then there's really nothing different and no issues to be able to serve.
