Despite one poster here claiming to have the knowledge of a former Supreme Court clerk and current Ivy League law school prof, pb thinks this is reasonable and was to be expected.

With Susie Wiles as Chief of Staff, Trump 2.0 is much more "ready for Prime Time" than during the first time around.

The court, in an unsigned 5-4 ruling powered by conservative justices, granted the administration's request to lift Washington-based U.S. Judge James Boasberg's March 15 order that had temporarily blocked the summary deportations under Trump's invocation of the Alien Enemies Act while litigation in the case continues.

Detainees "must receive notice after the date of this order that they are subject to removal under the Act. The notice must be afforded within a reasonable time and in such a manner as will allow them to actually seek habeas relief in the proper venue before such removal occurs," the majority wrote.

In Monday's decision, the court said that to challenge the legitimacy of their detention under the Alien Enemies Act detainees must pursue so-called habeas corpus claims in the federal judicial district where a detainee is located. That means that the proper venue for this litigation was in Texas, not the District of Columbia, the court said.


That last paragraph is the real point. The progressive Swampcult has been judge shopping to thwart Trump. It's that that the Court shot down.

    If Trump said to the conservative Clowns of the "Court" to get down on their knees and open their mouths - they would all do it and claim an 1898 law justified it. The only difference between the Supreme Clowns and a regular street prostitute is the street prostitute only needs to lie about their jobs when cops are within earshot.

    It seems to have escaped the notice of the majority on the SC that the power is granted to the President for use in a time of war. At the time. that would have been aimed at the French.

    It would rank as an Emergency Act only to be used in extreme situations against a specific wartime enemy.

    Indy: So, (unless there are any survivors from 1801 who were affected by this law) seems like it should no longer be enforceable. UNLESS - of course - you have a bunch of paid-off whores on the Supreme Court willing to do anything you tell them to do.

    This decision is being characterized as a win for the Trump administration. I don't believe that's quite accurate. The Supreme Court ruled that Trump can use this wartime act "for now". It also ruled on procedural grounds in as much the defense attorneys need to re-file in a Texas court. I think the main thing that the court decided is that potential deportees must get their day in court and have a chance to challenge the deportation.

    It added that going forward, detainees subject to the 1798 law "must receive notice" that they face removal under the Alien Enemies Act.

    I love it when you bring your expertise as John Jay's clerk into the SS conversation.

    What Trump won is a victory over judge shopping.

    I think his 2.0 plan has been sanitized by the Susie Wiles influence, and has a better chance of passing Supreme Court muster than previously. But, I think that the Court will do all it can to insure that illegals get their due process before it kicks their @$$€$ out the door. I hope it does.

    The Supreme Court on Monday threw out a judge's decision to block the removal of men alleged to be members of the Venezuelan gang Tren de Aragua to El Salvador without any legal process under the Alien Enemies Act.

    Like curt said the gangsters need time for a habeas corpus hearing to see if the law is applied. They can do this from jail.

    The main points were;
    1. "An activist judge in Washington, DC does not have the jurisdiction to seize control of President Trump’s authority to conduct foreign policy and keep the American people safe," Attorney General Pam Bondi said on X.

    2. Are they members of a transnational gang. (must answer "yes")

    3. Are they US citizens. (Must answer "no")

    4. Do their actions fall under the Alien Enemies Act (must answer "yes")

    My guess is that they'll give everyone an hour or so in court, let prosecution state the case, let them defend themselves and that will be that. Hopefully though, if there's a "wrong person" in the group that'll be found out (a little late, but still before they're back in el Salvadore). So if there are name mixups, etc, that will be one more checkpoint so they don't deport the wrong folks.

    In essence, they overturned the judge because (Law 101) he has to have a crime in his district. The district he decided on was in Texas.

    They've actually reviewed it as of late yesterday. So I did a synopsis and citation above. Just to catch you up.

    They can do court by video from the jail. The habeas corpus "relief" the judge has to agree to. If it fits the criteria above, there's no "relief." See above.
