Did you mean like Trump issuing an executive order contradicting Congress's TikTok ban?

Personally, I am not a TikTok user, but I don't see why it should be banned or what the fuss is about. If TikTok requires unnecessary personal information to sign up, that could be addressed. But it's hard to imagine what important information the Chinese can supposedly glean. What's at risk, our strategic dance moves? Top secret cat videos?

NEW YORK (AP) — During his first term as president, Donald Trump led the effort to ban TikTok, the hugely popular video-sharing site he said posed a threat to U.S. national security. But on the eve of his return to the White House, the president-elect is being hailed as the app’s savior.

WASHINGTON (AP) — The Senate passed legislation Tuesday that would force TikTok’s China-based parent company to sell the social media platform under the threat of a ban, a contentious move by U.S. lawmakers that’s expected to face legal challenges and disrupt the lives of content creators who rely on the short-form video app for income.

A decision made by House Republicans last week to attach the TikTok bill to the high-priority package helped expedite its passage in Congress and came after negotiations with the Senate, where an earlier version of the bill had stalled.

    You know what's happening here, right Curt? This has nothing to do with China or what's on TikTok - Leon and his pals want to buy it because it's the most popular video sharing app right now - worth billions. That' why they're not trying to ban it - they're trying to force them to sell it.

    I have said this in another topic. Why is Trump being allowed to make trade regulations? It is a power of Congress, not the President.

    Presidential Authority to Address Tariff Barriers in Trade Agreements The U.S. Constitution grants Congress the power to regulate trade with foreign nations and to lay and collect duties. Since the 1930s, Congress has periodically authorized the President to negotiate trade agreements and, among other actions, proclaim changes to U.S. tariff rates— known as Trade Promotion Authority (TPA). For example, Section 103(a) of the Bipartisan Congressional Trade Priorities and Accountability Act of 2015 (TPA-2015) authorized the President to enter into trade agreements with foreign countries to reduce “duties or other import restrictions” that the President determines are “unduly burdening and restricting” the United States’ foreign trade and to proclaim limited changes to U.S. tariff rates without further congressional action. In December 2020, President Donald Trump implemented a trade agreement with the European Union regarding tariff barriers using his proclamation authority under Section 103(a) of TPA-2015. TPA-2015 expired on July 1, 2021. Congress may consider whether to authorize tariff changes without congressional action in any future TPA legislation.

    Good question, actually. And, challenges to it have a better chance of prevailing with this Supreme Court than in previous years.

    Simplifying...

    Here, after Congress passes a law, the carrying out of the law becomes the duty of the Executive Branch. Get it: Execute-ive Branch. The branch of the government that Executes laws created by the legislature.

    Almost always, laws are executed by bureaucrats employed by an agency that is the part of Executive Branch.

    Bottom line: If Trump is acting under authority established by Congress, he is within his authority.

    As you may remember, at about the time the Supreme Court issued its Dobbs decision, it ruled in West Virginia v EPA that the Executive Branch cannot change policy in a way that Congress has not previously authorized.

    So, we'll see. But, while it's very likely that courts may overturn some of what Trump does. Probably not this.

    But, your question was probably rhetorical. Ill-informed, but rhetorical. If not, there you go.

    Of course it was not rhetorical. And, clearly I am not ill informed. I am pointing out that Trump does not have the Constitutional power to dictate trade terms or to impose tariffs. So when is he getting away with it in a system where each element is fiercely protective of its jurisdiction. Apartb from the current Supreme Court that is an arm of the Republican Party.
