Trump end(s) birthright US citizenship, incoming White House official says

WASHINGTON, Jan 20 (Reuters) - U.S. President-elect Donald Trump will issue an order intended to end birthright citizenship for U.S.-born children whose parents lack legal immigration status, an incoming White House official said on Monday.

Citing the 14th Amendment to the U.S. Constitution, the official said in briefing: "The federal government will not recognize automatic birthright citizenship for children of illegal aliens born in the United States. We are also going to enhance vetting and screening of illegal aliens."


I confess. I actually mocked Curt for suggesting that Trump would attempt to overturn the 1st Article of the 14th Amendment by Executive Order.

Now, I'm not a former Supreme Court clerk, nor do I teach at an Ivy League law school, but I'm confident that Trump will lose this in Court.

It's already been challenged.

I hope this case gets to the Supreme Court. This is something that needs a firm, unequivocal precedent.

"Of the people, by the people and for the people," baby!

    I agree with HtS. Trump will and should lose in the courts including SCOTUS on this 14th Amendment issue.

    I heard the Fox Chief Legal Correspondent splain, this morning what the argument will be and, there's a rationale there. But, this Supreme Court will not diddle with the clear text of an Amendment.

    You can take that to the bank.

    I looked up the argument against birthright citizenship that you may have heard. It seems to be making up exclusions that are not in the 14th Amendment.

    Trump advisers and some conservative legal scholars have previously argued that the idea of giving birthright citizenship to children of illegal immigrants is based on a misreading of the amendment.

    "Among the categories of individuals born in the United States and not subject to the jurisdiction thereof, the privilege of United States citizenship does not automatically extend to persons born in the United States: (1) when that person's mother was unlawfully present in the United States and the father was not a United States citizen or lawful permanent resident at the time of said person's birth, or (2) when that person's mother's presence in the United States at the time of said person's birth was lawful but temporary (such as, but not limited to, visiting the United States under the auspices of the Visa Waiver Program or visiting on a student, work, or tourist visa) and the father was not a United States citizen or lawful permanent resident at the time of said person's birth," the order says.


    I would imagine that many babies have been born in the US under the above circumstances. Since they are clearly not native-born in any other nation, where would Trump deport them to? And would that country be required to acept them?

    All persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States and of the State wherein they reside. No State shall make or enforce any law which shall abridge the privileges or immunities of citizens of the United States; nor shall any State deprive any person of life, liberty, or property, without due process of law; nor deny to any person within its jurisdiction the equal protection of the laws.
