The Supreme Court on Wednesday agreed to rule on whether former President Donald Trump is immune from criminal charges in his federal election interference case.

The high court granted Trump's request to pause the case from moving forward until they decide whether an ex-president is immune from being prosecuted for official acts performed while in office, as Trump claims.

The justices are poised to proceed quickly, with Trump's court briefs due within three weeks and oral arguments set for the week of pb's birthday. But it could take months for the court to issue an opinion.

If the justices rule in Trump's favor, the case will be dismissed.

The decision to take up the immunity claim extends a pause on a prior ruling from a lower appeals court, which roundly rejected Trump's argument that he cannot be prosecuted for challenging the 2020 election results because he was president at the time.

Special counsel Jack Smith, who is prosecuting Trump in D.C., had urged the Supreme Court not to let Trump delay the election interference case any further.

Big loss for the rush to justice crowd that believes Trump will lose if they can railroad him into a conviction before the election.

Big loss. Big, big loss. Heck! Big EFFINloss.

They will most likely rule against him (unless they want even peebs here to realize they ARE the swamp), but that's not the objective here. The objective is to delay justice long enough to save Trump.

  2. by HatetheSwamp on February 28, 2024 3:24 pm

    Indy,

I'm inclined to agree that they'll rule against him. But, the question they say they'll consider leaves an open door...

..."they (will) decide whether an ex-president is immune from being prosecuted for official acts performed while in office..."

This ain't about Trump. It's about the Separation of Powers and the presidency.

But, be honest with yourself. This is about Jack Smith desperately wanting to get a trial finished before a DC jury prior to the election. That's still possible, but not as likely...

...and what the Court just did is tell Jack that they ain't playing his game.

"Big loss for the rush to justice crowd..." --HtS

It's a case that's been three years in the making. Hardly a rush to judgment.

It's a win for the "justice delayed is justice denied" crowd.

Don't bet that it's ultimately a win for Trump. It's possible that a jury could find him innocent of election interference. Now he has a possible guilty verdict hanging over his head like Damocles sword. Most voters have reached a conclusion about Trump's guilt or innocence. An innocent person wouldn't be delaying every court case like Trump does. An innocent person would want the chance to clear their name as soon as possible. Most voters get that.

If non-Trump voters needed any extra incentive to vote against Trump they have it. Trump has already promised to pardon (or equivalent) himself. That doesn't sit well with the "nobody is above the law" crowd. By voting for Joe Biden they will be doing their part in keeping Trump out of office and in the courtrooms.

As an added bonus, Trump is burning through more high-priced lawyer legal fees.

Joe Biden will be reelected in a landslide. Huge. I've already been saying this for quite some time now.

Curt- If this has been going on for four years(?) why is it just getting to SCOTUS? It seems to me this would have been set up beforehand.

I'm not saying he'll win this, as I've said several times. I don't see his reading of "immunity" being a constitutional reading. I think this part of his SCOTUS stuff will not bring him happiness. I'm okay with that, needless to say.

I really wish the dims would have had their shit together a long time ago. They don't. They could have cleared this up no less than two years ago had they done that. Why did it take this long? Because the cases for this weren't proposed by the dims.

I'm pretty sure this is strictly on the dims timeline. So I don't fault them, I just wish they would have done it earlier. It's a bit of a chickenshit move. But it's politics also.

Adding a note: This is why Nikki hasn't gotten out. She's the only one on the GOP side that still is in the race and can pull out the numbers without going to other primaries. And, she's going to pick up a lot of pedojoe votes. She may lose the "only trumpsters." but the only trumpsters won't vote for a dim anyway.

I said three years. I was referring to the federal election interference case (Jack Smith's case) that has been years in the making.

SCOTUS is deciding on Trump's claim of presidential immunity for any and all crimes (including sending Seal Team Six to kill a political opponent) That issue is only a few months old, as Trump repeatedly appeals court rulings against him.

Curt- Okay on the timeline. My point was more about getting these to the courts right before the elections. Like I've said. Alot. I don't see any reason a court would find in his favor. That doesn't make sense to me at all. Yes, there are "some" issues, but not what trumpster is talking about. At all. So just to clarify my position on this hasn't changed.

Anyone else notice that the Clowns jumped right on that Colorado thing - but they're putting this one off for a couple months?

It's all about pay back for the Clown's masters.

  10. by HatetheSwamp on February 29, 2024 9:38 am

They expedited the Primary election thing because primaries are taking place now. Even at that, they haven't issued a ruling.

In this case, there's no reason to rush the immunity ruling... except if your election strategy involves lawfare.

You have a LOT of excuses for the Swamp for a guy who pretends to hate the Swamp.

  12. by HatetheSwamp on February 29, 2024 10:29 am

    Not at all.

What they are doing with the immunity case is perfectly usual.

The mild surprise for me is that they took the case. pb's Legal Goobers doubted they would.

  13. by Curt_Anderson on February 29, 2024 10:45 am
“Perfectly usual”!? There is nothing usual about this immunity case before the Supreme Court.

  14. by HatetheSwamp on February 29, 2024 10:57 am

Really, Curt? The maddening thing for the Dem progressive Swampcult is that the courts have handled it is a very usual way.

Your take seems to be that the Bill of Rights doesn't apply to Trump. Clearly, the federal Judiciary doesn't agree.

  15. by Indy! on February 29, 2024 12:52 pm

I stick by my already proven and holding 100% completely accurate assessment that every decision the Clowns make is based on politics... including this one.
