Alan Dershowitz, member of pb's Legal Advisory Council, AKA Legal Goober #1, has a take on the Georgia Indictment very similar to LG #3, Andy McCarthy. Both say that, based on the way Fani Willis has organized this case, there's no way that it's remotely possible this case goes to trial in six months probably not even before the election.

#1 literally says that she should be ashamed of herself. pb quoted #3 yesterday as saying Willis' handling of the indictment is "amateurish."

pb gets the impression that both of his Goobers think Willis is too politically radical and too ambitious...and probably not up to handling the complex case she created.

TDS is a dangerous thing. This may prove to be THE case in point.

Really nice interview of Legal Goober #3 by that gay Guy Curt never heard of.

McCarthy says that Trump may be vulnerable to some of the lesser charges but not of the charges making headlines...

...and, that, with 19 defendants, this trial will take months. Figuring out when it's held during election year, with the other trials lining up will be a challenge.

Willis doesn't realistically expect to finish the Georgia trial before the election. Her case is very complicated with a lot moving parts.

Jack Smith took essentially the same case and simplified it with fewer charges and fewer defendants because he wants to have a verdict before the election.

The Georgia case will be underway during the campaign season. It may be like the OJ trial of must see TV. There will be the Trump crazies like Sydney Powell on the stand. There will be Republicans testifying against Trump. There will Trump's former allies flipping on him. There will be audio, video and graphic evidence against him. The defense seems to be relying on their arguing that Trump is sincere but delusional, lying is protected speech and nitpicking of technicalities. They won't--and cannot--argue that somebody else is the real culprit.

The indictments may not have had a measurable impact on Trump's poll numbers...yet. When he is actually on trial, that will change.

Trump doesn't need to be found guilty by election day for people to form an opinion. Remember, OJ was found innocent in his criminal murder trial. Most people still felt he was guilty regardless.

Ninety percent of life is just showing up. If Trump doesn't show up for his trial(s), jurors and TV viewers/voters may draw a negative inference from his absence.

If this trial is underway during the election season, when will the other trials take place?

  4. by Curt_Anderson on August 15, 2023 3:18 pm
What is to stop them from running concurrently? It is the defendant’s option whether to appear in court or not.

  5. by HatetheSwamp on August 15, 2023 3:28 pm

I don't know about that. But, are you assuming that Trump would choose not to be present?

  6. by Curt_Anderson on August 15, 2023 3:39 pm
He hasn't appeared in courtrooms when he's had the chance. Other than a videotape appearance, he wasn't at the E. Jean Carroll trial, for instance.

There may be conflicting schedules which precludes his appearance(s).

  7. by HatetheSwamp on August 15, 2023 3:45 pm

We'll see. But, a defendant has the right to face his accusers.

Carroll was a civil suit, not a criminal trial.

    Curt,

This is Dershowitz essentially, for the most part, explaining the 101 of the Georgia case and trial. I recommend it for its information.

Dershowitz says specifically that Trump will have to be physically present.

The ol' Dersh-bag said Trump "has to" appear, but I think he was talking good defense tactics, not about any legal requirement.

"The defendant has a right to be present at trial, but this is a personal right which may be expressly waived." It is a right, not an obligation.

be ready for the prelims for constitutional repercussions.

Also, what part of GA law was broken. Please explain that to me. please cite.

    Curt,

How many teams of lawyers do you think Trump should be required to have?

  12. by Donna on August 16, 2023 8:19 am

Trump isn't required to have any lawyers.

    od- Read the GA indictment.
