Florida judge overturns CDC mask mandate for public transit, planes

A federal judge in Florida on Monday vacated the Biden administration's national mask mandate for planes and other forms of public transportation, arguing that the Centers for Disease Control and Prevention had overstepped its authority.

    The mask mandate expires in a couple of weeks on May 3rd anyway, so the ruling isn't a big deal. The Trump-appointed judge ruled that the CDC reasoning for a mask mandate, namely it was for "sanitation", was not the appropriate reason.

    Decent question.

    One thing we who believe in the Constitution believe about the Judiciary Branch of government is that it is in place to judge the overreach of the Executive and Legislative Branches.

    One thing those of us who love the Constitution understand is that the Constitution and the Bill of Rights are in place to preserve individual liberty and to limit the intrusion of the government into the lives of citizens.

    Following the science, the overturning of these restrictions on individual freedom in this case seemed to me to be a no-brainer.

    I am surprised that a judge had the courage to stand up to our Flatulent Former Truck Driving emperor wannabe, though.

    I don't see anything sinister in any mandate. Biden was just trying to protect the health of Americans. I'm certain that he will accept the ruling gracefully.

    This is where it seems to me that you are not objective.

    As became clear to me during the pandemic, you are predisposed to support governmental suppression of individual liberty...at least according to the rulings of our Supreme Court.

    We are a people protected by a Bill of Rights, i.e, this nation is built on the convictions that people are free and that government must be prevented from, unnecessarily, intruding into the lives of individuals.

    These days, COVID-19 cases, hospitalizations and deaths are extremely low. The judge was right to rule against unwarranted government intrusion.

    I voiced that opinion, but I'm fine with the court's rulings. I was particularly concerned then about catching COVID being that I work in grocery stores, and I personally know people who either died or were hospitalized due to COVID.

    There probably does exist a threshold where the government would be derelict in its duty to impose mandates. For example, what if there were a very contagious virus that killed 50% of those infected? 25%? 10%? I started a discussion a while back on that. As I recall, no conclusions came out of that discussion.

    If this virus were much more deadly the government would be justified in being more autocratic than it is with COVID-19 now.

    That's why nearly everyone was happy to comply with, 15 days to slow the spread. When the reality that the death rate was miniscule for nearly everyone, problems with Big Brother overreach v individual liberty surfaced.

    So we're in agreement on that. The question that no one seems to be able to answer is where and by who's authority should that line be drawn, which of course would vary according to the issue.

    It's incumbent on the Executive and Legislative Branches to employ good judgment. The authority to decide, in our government, is the Judicial Branch's.
