(POLITICO)The Jan. 6 select committee says its evidence has shown that then-President Donald Trump and his campaign tried to illegally obstruct Congress’ counting of electoral votes and “engaged in a criminal conspiracy to defraud the United States.”

In a major release of its findings, filed in federal court late Wednesday, the committee suggested that its evidence supported findings that Trump himself violated multiple laws by attempting to prevent Congress from certifying his defeat.

“The Select Committee also has a good-faith basis for concluding that the President and members of his Campaign engaged in a criminal conspiracy to defraud the United States,” the committee wrote in a filing submitted in U.S. District Court in the Central District of California.

[The] committee described a president who had been informed repeatedly that he lost the election and that his claims of fraud were unfounded — only to reject them and continue to mislead the American public.

[Trump] then pushed top advisers to continue strategizing ways to overturn the election results.

The panel released its findings as part of a legal push to force John Eastman, an attorney who was a key driver of Trump’s strategy to subvert the 2020 election, to produce crucial emails tying together elements of the scheme they described.



(NY Times)As part of the suit, Mr. Eastman sought to shield from release documents he said were covered by attorney-client privilege. In response, the committee argued — under the legal theory known as the crime-fraud exception — that the privilege does not cover information conveyed from a client to a lawyer if it was part of furthering or concealing a crime.

Mr. Eastman then argued the committee had offered “no evidence” of the existence of a crime-fraud exception, prompting the committee’s latest filing.


The quandary for Trump and Eastman are that they cannot seriously argue that they honestly believed Trump somehow won after losing 60 court cases, innumerable recounts proving otherwise and AG Barr and others in the administration saying Biden was the rightful winner. Willful ignorance is not a legitimate defense. --CA

    Bahahahahahahahahahaha.

    Now, I despise Trump. I think he's despicable. (Aw shucks. I forgot to take my Alzheimers meds again!)

    So, as po often says, [They] got Hoosier.

    They hope to have something but they need to find some way to "force" John Eastman to provide what they hope would be evidence.

    Y'know? One difference between this Committee and a Grand Jury is that, to have served on the Committee, you have to have begun with the conviction that the person who is the focus of the inquiry is guilty...and, in this case, you have already voted to impeach him.

    Trump may be guilty of something.

    But, in spite of your headline, Curt, the article proves that this Committee still has nuthin and is now attempting to FORCE an attorney to give it material that may indicate that they might have something.

    I remember.

    I remember how, back in the day, you and po and the other TDSers here were convinced that, in a short time, the Committee would prove that Trump planned an insurrection.

    Now, it's fallen to the position of needing to force the production of evidence that Trump...or maybe even only those in his inner circle...played around with how a 130 year old law was carried out.

    Your Committee is a hoot.

    And, you?...you're, uh, hootier.

    I'll repeat. I think that the best thing for the GOP is that Trump could have been found to be guilty of something substantial.

    Sadly for me, this article seems to prove, once and for all, that ain't happening.

    You are wrong if you think that the January 6th Committee should be likened to a grand jury. They are not expected to be an impartial jury waiting to hear a prosecutor's case against a defendant.

    It's official name is "The National Commission to INVESTIGATE the January 6 Attack on the United States Capitol Complex".

    When the committee is done with their investigation they will present evidence to Merrick Garland and the Department of Justice. It will be up to the DOJ whether or not to prosecute.

    My point being that people trust Grand Juries...with reason.

    But, the January 6 Committee? There's no reason to think anything it concludes can possibly be based in truth.

    It's ironic that the Committee putters away, undaunted, mirroring Putin's authoritarianism.

    Do you think that, maybe, Trump will end up in Siberia?...

    ...even though the Committee has given up the sham of finding that Trump launched an insurrection!!!!!?

    You have a remote relationship with truth. Anybody who thinks Biden wasn't the legitimate winner of the presidential election (without a shred of evidence) has no credibility on the subject of truth.

    The January 6 Committee deals with January 6, not the election.

    There's no question that the Flatulent Fool received the greatest number of countable votes, honest and otherwise.

    And, there's no evidence that OrangeMan led an insurrection on January 6.

    The Commission is not investigating the election. It is investigating the pro forma count and certification of electoral votes. The insurrectionists attempted to interrupt that count and Trump and his minions tried to persuade Mike Pence to throw out certain states' electoral votes so that Trump would be declared the winner.

    Trump, Giuliani, Eastman et al and the slack-jawed insurrectionists are guilty of variations of the same basic crime, namely attempting to stop the Vice President and Congress from performing a constitutionally mandated duty.

    The Electoral Count Act is the means through which the presidential vote is counted. Everything the Trump gang attempted was, according to that law.

    It didn't succeed but I can't see that there's a crime in attempting to use the provisions of the law to one's own advantage.

    It's a crime because it's fraud.

    It is possible to use legal remedies, apply obscure laws, etc. in a fraudulent and illegal manner.

    Trump had no legitimate or logical reason to believe he won the election.
