    Notice that Bellows uses the word "engaged" which appears in the 14th. She also mentions "given aid or comfort to the enemies thereof."

    In case anybody was wondering about the legal definition, "insurrection n: the act or an instance of revolting esp. violently against civil or political authority or against an established government."


    “I am mindful that no secretary of state has ever deprived a presidential candidate of ballot access based on Section 3 of the 14th Amendment. I am also mindful, however, that no presidential candidate has ever before engaged in insurrection.,” [Maine's Secretary of State Shenna] Bellows wrote.

    Similar arguments were successful in Colorado, where the state’s highest court ruled 4 to 3 last week that Mr. Trump should be excluded from the ballot. That court cited a section of the amendment that prohibits people who have taken an oath “to support” the U.S. Constitution from holding office if they have “engaged in insurrection or rebellion against the same,” or have “given aid or comfort to the enemies thereof.”

    I’m in full agreement with our state’s Secretary of State Shenna Bellows and I hope she is successful and other states join her.

    Donald Trump is not fit to be president, either morally or mentally. We should not even be considering making him the most powerful man on earth.

    Anyone who recognizes this should be working full time to legally prevent that from happening.

    I think Maine’s Secretary of State Bellows has made a strong case and I hope she prevails. I would however be more than pleasantly surprised if she is able to considering the makeup of the present Supreme Court. I do think (hope) shining a light on all of this will now help people to see that it’s time to re-examine our interpretation of the Constitution and work on fixing the flaws that make it possible for someone like Trump, who is a clear and present danger to our country and is totally unfit to be President of our country to be elected to the highest office when the majority of Americans do not want such a man sitting in the Oval Office with the power that goes with it.

    Why are you concerned about that? Dumping Trump (to use your term) wouldn't be done illegally. If Trump is unable to run because of the 14th Amendment or is busy serving a prison sentence on one or more of his indicted crimes, it will be decided legally in a courtroom.

    Furthermore, since Trump undoubtedly would appeal anything that prevents his re-election, the decision would be approved by the Supreme Court.

    Unfortunately, that's EXACTLY what you (all) propose to do. And doubled down in multiple threads that YOU started and claimed trumpster has NO right of due process. So for you to whine about it now is just plain stupid. It has been Lead and I that have wanted this done LEGALLY so trumpster can't whine as much as you do. I would like him to be thrown off the ballot. I don't want it wrapped up in court to be overturned by something as stupid as a due process error that you should have learned in sixth grade (had you gone to an accredited school).

    Nobody here says that Donald Trump should not be afforded due process. You mistakenly believe that Donald Trump is being denied due process. In simple terms due process is normal, fair, legal treatment that is applied equally to everybody. What you really want is for Donald Trump to be given special treatment.

    I just wish Donald Trump didn’t abuse the justice system to avoid and delay due process.

    It is NOT proven in court that he did. Ergo, you are illegally denying a citizen something they otherwise have the right to do. That's a due process violation.

    We couldn't call OJ a "murderer" until after the trial. And guess what! Same thing here. Would he be found guilty? dunno. Strange things happen in trials. I would hope so, but I never make bets on trials.

    The cart (being able to run for federal office) goes AFTER the horse (trial of insurrection). Saying he is guilty is an "assumption" he was found guilty in a court. That's the way the system works. Even under Common Law, where we got it. French law, kinda.

    You are accusing trumpster of a crime. Period. You've said this like you vote. Early and often. You can "say" or believe in your TDS mind that he is. No one cares about your feelings. They don't matter until due process is complete. He still has the same rights as someone that murders and rapes. You have "evidence" great. The evidence against a rapist and murderer are things like DNA (inside the victim, and maybe under the victim's nails), fingerprints, blood at the scene, or on their clothing, etc. They are still presumed INNOCENT.

    A presumption of innocence means that any defendant in a criminal trial is assumed to be innocent until they have been proven guilty. As such, a prosecutor is required to prove beyond a reasonable doubt that the person committed the crime if that person is to be convicted. To do so, proof must be shown for every single element of a crime IN THE COURT OF LAW.😱

    I think what we are saying, and have been saying for quite some time now, is that he engaged in insurrection. There's no actual realistic doubt about that.

    Now if you want to find him "guilty" of insurrection in a fully legal sense in order to put him in prison or fine him or something like that, you'll need him to be found as such in a court of law in a trial by a jury of his peers.

    But as far as keeping him off the ballot is concerned, the mere fact that he undeniably, blatantly, and oh most epically engaged in insurrection is all that is necessary to disqualify him for holding the office of president.

    We all know Trump is using his rights and due process to delay his upcoming trials but so far, other than simply saying Trump is being denied due process or that we are trying to deny Trump due process, neither has said, and an example would be nice, exactly how or where Trump is being denied due process.

    I have given what SCOTUS has given in the wording of "Life, liberty, and property." THAT MEANS DUE PROCESS (maybe not when it comes to trumpster, but LEGALLY it does). There are at least three posts on different threads that reference that. Cornell Law agrees with me. The constitution agrees with me.
