White House special counsel Dick Sauber questioned the validity of the GOP-led impeachment inquiry into President Biden on Friday in a scathing letter sent to House Oversight Chairman James Comer (R-Ky.) and House Judiciary Chairman Jim Jordan (R-Ohio).

In the four-page letter, Sauber demanded that Comer and Jordan withdraw their subpoenas and requests for interviews with members of the Biden family and aides, arguing that since the House did not hold a floor vote on the impeachment inquiry, it has not been formally authorized by the legislative body as required by the Constitution.

“In fact, both of you previously supported the position that moving forward with an impeachment inquiry without a vote of the House ‘represents an abuse of power and brings discredit to the House of Representatives,’ ” Sauber wrote, quoting a 2019 resolution disapproving of then-House Speaker Nancy Pelosi’s (D-Calif.) decision to unilaterally initiate an impeachment inquiry into former president Donald Trump.

    OD thinks that Biden not bending over backwards to cooperate with Comer means "he must be guilty". Comer's committee has not found any evidence that Joe Biden himself benefited from his son’s business dealings, much less committed a crime. Comer has nothing more than innuendoes and smears.

    In America law enforcement or congressional committees cannot demand a person's email history to see if any crime was committed. That's unreasonable search and seizure. That's also a witch hunt, unlike Trump's misuse of the term.

    Of course, Biden is following the precedent that congressional Republicans, including Comer and Jordan, established for Trump. In Trump's case there was an actual investigation of Trump's impeachable activities. Comer and company are trying to impeach the President's son.

    Apparently OD and HtS are oblivious to the fact that Trump has done nothing but delay and obstruct all of the impeachment or criminal investigations into his activities.

    Do you really believe that? Other than Comer asserting he and his committee HAVE found evidence that Joe Biden himself benefited from his son’s business dealings and criminally so, provide a link to a credible source, even Fox News, etc., that shows incriminating evidence.

    And by evidence, I mean the kind of incriminating stuff they have on Donald Trump like boxes of classified documents in his bathroom, or his voice recorded from a telephone conversation, financial statement documents, etc.

    "So as curt has said many times, "he must be guilty." That's the only reason he would not cooperate with an investigation." ---OD (see first link)


    I've never said, "he (Trump) must be guilty" or words to that effect. Here is what I've actually said, "Just because Trump acts guilty doesn't mean he is guilty." (See second link, comment #16) I also said, "Trump is innocent unless proven guilty, but he’s guilty". (See third link)

    Back to the lead post.

    I do agree with the non-vote being an issue. It's protocol that has to be followed. I wouldn't pull the subpoenas though. I'd do the vote, and if it didn't pass, I could pull them. My question is about what the committees are up to and if they're going to use the committees as a workaround. If they claim it's only part of the committee, maybe it could work. I think it a crappy way to do it, and it's politics, so all bets are off for me.

    Flip side is right is right. If little nancy couldn't do it, the GOP shouldn't be able to.

    The roles are reversed now. So expect both sides to mimic what the other side did for trumpster. For the GOP, that means they can create as they go. If they find something as they're doing the hearings, that's fair game. Remember, the dims didn't have "charges" because DOJ told them they can't use the Steele dossier. So the dims whining about charges now is useless. As they say, "suck it up, buttercup!"

    Comer suggests impeachment vote not ‘best path’ on Biden probe
    During the hearing, Democrats were quick to ask Comer and other GOP members to name the crime or misdemeanor that is the root of their investigation.

    Rep. Alexandria Ocasio-Cortez (D-N.Y.) questioned why the impeachment was proceeding if the GOP has “no charges.” She said she has “yet to hear” from Comer that Republicans are specifically charging Biden with anything, since he often referred to wrongdoing by the “Biden family.”

    “I am not hearing the specific allegation by this committee. What is it? It is not here. And that is the problem. The story is, when this committee knew they were working with falsified evidence? That is the story,” Ocasio-Cortez said during the hearing.

    I agree with AOC about as often as I agree with po. IMO, this last hearing was warranted. But, it became clear to me about what it turned out was 2/3 of the way through that:

    1. GOPs have found a ton of evidence of RICO and FARA crimes.
    2. GOPs couldn't connect them to the "dithering and diminished" Doddering Old Fool,... sonofabitch!

    I think I understand what the GOPs are doing. Biden has turned the DOJ into Stalin's KGB. No criminal referral to the DOJ will go anywhere.

    But, as Obama said. Elections have consequences.
