    "Under the First Amendment, there's no such thing as a false idea or a false opinion," Dershowitz told co-hosts Bianca de la Garza and John Huddy.

    "The remedy for false ideas and false opinions is to respond to them and write better ideas and better opinions, not to criminalize what somebody said or did consistent with his belief that the election was stolen."

    In the indictment Jack Smith specifically acknowledges that Trump has First Amendment rights to say whatever he wants regardless of its truthfulness. Trump wasn't indicted for what he said. He's being indicted for his illegal actions which followed his false statements.

    Dershowitz doesn't explain that the First Amendment doesn't protect false statements that are defamatory. It doesn't protect a robber's utterance of "stick 'em up and give me your money!" The First Amendment is not an absolute protection to say whatever you want wherever and whenever you want.

    Read the indictment. Trump isn't being charged for his stated opinions.

    I don’t know why there’s a Twitter search warrant. I don’t know that the answer to the question is being reported anywhere. But there could be a lot of reasons that have nothing to do with the first amendment. For example, maybe Jack Smith is looking to see if Donald Trump use Twitter to incite. Inciting a riot is not protected free-speech. Or maybe he wants to see if Trump had shown consciousness of guilt.

    With a warrant, Smith can go into his account and look at things like what is in the drafts folder and other parts of it that aren't made public.

    Bill, seems like you're really worried. I can guarantee you that after going through Trump's whole twitter account for the time periods he wants to see, he isn't going to find anything and then come out and say, "You can't say that, Mr. Trump. I'm charging you with.... something... for saying that."

    So rest easy, Bill. Your cult leader's First Amendment rights are fully secure. They aren't even at issue in any part of this case.
