This is why I think Cannon's decision was so amateurish and will not hold up when appealed. It is, like all of Trump's legal tactics, an attempt to delay. It has worked for him a lots of times in the past, but it won't work this time." See link


The three judges are all Republican appointees, including two appointed by Trump.

CNN — In a major defeat for former President Donald Trump, a federal appeals court on Thursday halted a third-party review of documents seized from his Mar-a-Lago estate.

The ruling removes a major obstacle to the Justice Department’s investigation into the mishandling of government records from Trump’s time in the White House.

The three-judge panel of the 11th US Circuit Court of Appeals reversed US District Judge Aileen Cannon’s order appointing a so-called special master to sort through thousands of documents found at Trump’s home to determine what should be off limits to investigators. The court said the judge should not have intervened in the first place.

“The law is clear,” the appeals court wrote. “We cannot write a rule that allows any subject of a search warrant to block government investigations after the execution of the warrant. Nor can we write a rule that allows only former presidents to do so.”

    Like Donna, I was unfamiliar with the term critical legal studies (CLS) which OD mentioned in another thread as a precursor of critical race theory.

    I am not so cynical that I believe that the purpose of our laws is to oppress the marginalized as CLS posits. At least not intentionally. It does happen though. Redlining of neighborhoods is one example. Certainly the poor are at a disadvantage in our justice system. We have a shortage of public defenders in Oregon currently. I also believe that the very wealthy can abuse and use the justice system in ways that most of us cannot even consider. There is no better example of that abuse than Trump. I am sure every burglar, robber and shoplifter would welcome a special master to slow up the wheels of justice.

    So I was heartened by the Appeal Court's statement (in the last paragraph of the above article). They said they can't justify carving out a special exemption to the law for Donald Trump.
