What exactly is your problem with the Bill of Rights?

Graham hasn't said he won't testify. He's asserting his most basic Rights.

We are living in an age where Dems make a habit out of denying due process. Who can blame the GOPs!!!!?

These guys are doing every thing they can so they don't have to face the judicial system thus face due process. Are you suggesting that Graham is asserting his right not to incriminate himself?

Trump, Graham, Sidney Powell, Mike Lindell, Steve Bannon, Peter Navarro, Giuliani, Trump's sons, and practically every other MAGA-world denizen have gone to great lengths to avoid answering questions under oath.

It happens all the time...because our citizens have liberties.

Sure. That happens if the subpoena is deemed unreasonable or oppressive by the court. But no subpoenas have been quashed in any of these cases. Can you cite any examples of it happening in these cases?

Not to my knowledge. I'm not aware that a subpoena has been challenged, though.

As a man born in freedom, are you suggesting that Graham shouldn't challenge the subpoena?

Graham has the right, but it is an abuse of our constitutional rights. Only the very wealthy and powerful can afford to file appeals with the various levels of courts. Average citizens like you and me cannot prevail upon the Supreme Court to avoid our providing testimony in a court case.

When people like Trump file delaying motions, demand a special master, file appeal after appeal, inundate the court with frivolous motions and countersuits it's an unnecessary waste of time and a burden on the justice system and upon the victims/plaintiffs who often cannot afford to pursue justice indefinitely.

Here’s where the Trump voters who think we don’t believe in, or that we want to do away with the 5th Amendment have it all wrong.

We fully understand why we have the 5th and why it’s so important and necessary. We don’t want the government to be able to force us to confess to a crime we didn’t commit or to force us to say something the government might try to use against us in order to make it seem like we committed the crime that we didn’t commit. It’s for our own protection.

That doesn’t mean that in our own minds when we see someone using the 5th to avoid answering questions we can’t use that to influence our own conclusions about the person’s guilt or innocence. Naturally, a jury can’t do that, they are not supposed to use the use of the 5th as an indication of guilt...but we can...because we have no power to convict the person of a crime.

I think Trump is guilty as hell of committing most of the crimes for which he’s being investigated. And I think his underlings are using the 5th to protect Trump and themselves from accountability.  WE all know how that works and we’ve seen how mobsters and racketeers use it for the same purpose.

That doesn’t mean we don’t think criminals or anyone else shouldn’t be allowed to use it when being questioned by the government.

I think any free-thinking American that submits to the J6 kangaroo court has really bad legal representation. It's like showing up in a court in the Congo, Afghanistan, Burma during the revolution, or Cuba. The end is predetermined. You're going to the firing squad or beheaded. Why would I willingly do that? As we're reminded over and over again, J6 not bound by US law (thanks Curt, Isla, et. al.). It's at the whim of a group that gets paid per head they take. During elections, they get votes by the body bags they produce, and the mass graves they fill.

Those on trial have no rights given any US citizen. You keep whining about the 5th Amendment, when that is the least of any worries for those being interrogated. It kind of looks like Hu Jintao being carted off, never to be seen again (alive).

Supreme Court tells Lindsey "no".

CNN The Supreme Court declined on Tuesday to block a subpoena for Republican Sen. Lindsey Graham to testify in front of an Atlanta special grand jury investigating efforts to overturn the 2020 presidential election in Georgia.

There were no public dissents from the order.

The South Carolina senator had filed an emergency request asking the justices to halt the testimony – currently scheduled for November 17 – while legal challenges play out.
